Resumen

O presente trabalho analisa o Acordo sobre o Aquífero Guarani sob a égide do Direito Internacional dos Aquíferos Transfronteiriços, evidenciando os progressos e retrocessos trazidos pelo instrumento em comparação com as normas e projetos existentes sobre o tema. Busca-se, assim, elucidar o possível impacto do Acordo sobre o Aquífero Guarani e quais as eventuais tendências de regulação desse tipo de recurso no Direito Internacional. Para tanto, será realizada uma análise comparativa crítica, considerando os dispositivos de instrumentos internacionais de abrangência geográfica similar, além da reação doutrinária e dos Estados a essas normas. Dessa forma, inicialmente será apresentado o contexto da criação do Acordo, bem como a construção histórica que culminou nesse contexto. Posteriormente, serão discutidas as disposições normativas trazidas pelo Acordo, ponderando as correspondências, progressos e retrocessos em relação ao modelo desenvolvido pela Comissão de Direito Internacional sobre o tema. Conclui-se que o Acordo inova por ter sido concebido em caráter preventivo e não por meio de um conflito de utilização. Além disso, o Acordo codifica diversas normas que não são geralmente aplicadas no âmbito dos aquíferos transfronteiriços, ainda essas não tenham sido criadas ou modificadas pelo Acordo.
