Parity of participation principle by Nancy Fraser and changes in Brazilian labour law: working women perspectives and social justice distantiation

Abstract

During globalization development and, consequently, international influences on State policies, Brazil sanctions a change in labour law according to neoliberalism parameters: flexible labour relationships, rights negotiation until then forbidden, weakening trade unions. These are only some consequences of this openness in legislation; with regards to working women, frequently disregarded as subjects that need an alternative regulation, their situation as marginalized was perpetrated. In this context, it is important to recapture Social Justice foundations from the point of view of Nancy Fraser, one of the brightest philosophers to study this topic. Especially including the parity of participation principle, normative center of her theory, it is used both as a way of report injustices institutionally stablished and as a way to evaluate solution propositions to such problems. Only strictly observing Social Justice parameters it will be possible to mitigate women condition in labour, making women recognized as subjects of rights and turning their conditions of life maintenance equivalent to men’s.
