JUDICIALIZAÇÃO DA POLÍTICA NUMA PERSPECTIVA MARXISTA: A POLÍTICA COMO ASPECTO INERENTE AO CAMPO JURÍDICO / JUDICIALIZATION OF POLITICS THROUGH A MARXIST PERSPECTIVE: POLITICS AS AN INHERENT ASPECT OF LEGAL FIELD

Abstract

Resumo: O presente artigo busca dissecar o funcionamento do Estado no capitalismo, através dos olhos do método materialista-histórico-dialético, para lançar análise sobre as origens do pensamento que aponta a judicialização da política como um fenômeno que pode ser explicado pela própria ciência jurídica, com razões em si mesmo. A literatura marxista apoiou a definição de conceitos fundamentais para o estabelecimento do debate acerca do tema.

Abstract: The present article seeks to dissect the functioning of the state in capitalism, through the eyes of the materialist-historical-dialectical method, to launch an analysis about the origins of thought that points to the judicialization of politics as a phenomenon that can be explained by law as science, with reasons in itself. The marxist literature supported the definition of fundamental concepts for the establishment of the debate on the subject.
