Abstract

The first decades of the twentieth century were marked by an under legal dispute between criminological aspects inspired by the positivism. These strands were linked to an approach of abnormality, racial segregation and social progress, so how were linked to a speech by gender, which was even more in evidence in the world of the judiciary. It brings into focus a crime of infanticide committed in the city of Florianopolis, a city of moral conservatism, particularly on the female behavior. It is from the speeches in this crime, which can analyze the social gaze that falls on the female offender and it is also addressed through the speeches that is possible to perceive the line in criminological existing system of judicial district of Florianopolis in the decade of 1930.
