Dworkin e Gadamer: Qual conexão?

Distingo três sentidos da tese da conexão entre Dworkin e Gadamer e examino a plausibilidade da tese em cada um deles. Limito-me, no que toca a Dworkin, à teoria do direito como interpretação exposta em O Império do Direito (1986) e, no que toca a Gadamer, à sua hermenêutica filosófica exposta em Verdade e Método (1960). No sentido de influência direta, a tese afirma que a teoria de Dworkin é influenciada pela de Gadamer e pode ser vista como aplicação desta ao âmbito do direito. No sentido de cofiliação teórica, a tese afirma que, embora não tendo sido influenciada pela de Gadamer, a teoria de Dworkin pertence à mesma tradição hermenêutica que a de Gadamer. No sentido de afinidade epistêmica, a tese afirma que, embora não tendo sido influenciada pela de Gadamer e não pertencendo à tradição hermenêutica, a teoria de Dworkin tem afinidade epistêmica com a teoria de Gadamer, passível de ser explorada e desenvolvida para seu enriquecimento. Mostro que a tese não se sustenta nos dois primeiros sentidos e que, mesmo no terceiro sentido, em que se torna mais plausível, deve ser aceita com cautela e parcimônia.

Abstract:

I distinguish three meanings of the thesis of a connection between Dworkin and Gadamer and examine the plausibility of it in each one of them. I limit myself, as for Dworkin, to the theory of law as interpretation presented in Law’s Empire (1986) and, as for Gadamer, to the philosophical hermeneutics presented in Truth and Method (1960). In the meaning of direct influence, the thesis claims that Dworkin’s theory is influenced by Gadamer’s and can be seen as an application of the latter to the domain of law. In the meaning of belonging to the same tradition, the thesis claims that, despite not having been influenced by Gadamer’s, Dworkin’s theory belongs to the same hermeneutic tradition than Gadamer’s does. Finally, in the meaning of epistemic affinity, the thesis claims that, despite not having been influenced by Gadamer’s and not belonging to the same hermeneutic tradition than Gadamer’s does, Dworkin’s theory has got some epistemic affinity with Gadamer’s, which can be explored and developed in the benefit of its enrichment. I show that the thesis does not hold in the two first meanings and that, even in the third one, where it becomes more plausible, it should be taken cautiously and sparingly.
